The first conversation, structured.
The consultation is where we assess whether we can assist, identify the nature of your matter, and discuss how it would be handled. It is also where fee arrangements are first discussed.
Enquiry & conflict check first
Every engagement begins with an enquiry and a conflict check. No substantive legal advice is provided until the conflict check is complete and there is no bar to acting. This protects both you and the firm.
Consultation fee is disclosed up front
Our initial consultation process and any associated fees depend on the nature and complexity of the matter. We are transparent about fee arrangements from the outset and will confirm any consultation fee before the meeting is arranged.
No confidential information until a mandate is in place
Until a conflict check and formal mandate are completed, information you submit is not treated as privileged. We will arrange a secure channel for sensitive information once a mandate is confirmed.
Outcome of the consultation
If the matter is appropriate and we can assist, we propose a scope of work and a fee arrangement, confirmed in a written mandate. If we cannot assist, we will say so plainly and, where possible, suggest a more appropriate route.
Four ways fees are structured — chosen to fit the matter.
Different matters call for different fee structures. The appropriate approach depends on the scope, complexity, urgency and predictability of the work. All fee arrangements are confirmed in a written mandate.
Scope-Based
The fee is agreed based on a defined scope of work — what the matter requires, and what it does not. Scope-based billing suits matters where the work can be clearly bounded up front, and provides clarity on what is included in the fee.
Fixed-Fee
A single agreed fee for the completion of a defined task or matter. Fixed-fee billing is appropriate where the work is predictable in scope and complexity, and offers clients certainty on cost from the outset.
Hourly / Matter-Based
Fees are calculated on the basis of time spent, recorded against the matter. Hourly billing is generally used for complex or unpredictable matters where scope cannot be defined in advance. Time records are itemised in billing statements.
Disbursements
Out-of-pocket expenses incurred on your behalf — such as sheriff fees, court filing fees, counsel’s fees, and search fees. Disbursements are billed separately from professional fees and are explained in the written mandate.
Contingency Fee Note
Contingency arrangements are limited and conditional.
Contingency fee arrangements may be available only in matters where permitted by South African law (principally under the Contingency Fees Act 66 of 1997) and are always subject to a written agreement that complies with the statutory requirements.
We do not offer a blanket “no win, no fee” arrangement across all practice areas, and we do not advertise contingency availability on any specific matter type without first assessing the matter. Where a contingency arrangement is appropriate and lawfully available, it will be documented in the written mandate before work begins.
A clear path from enquiry to delivery.
From the moment you contact us to the conclusion of your matter, the process is structured and communicated. Here is what to expect at each step.
Initial Enquiry
You submit an enquiry through our contact form or call our office. We acknowledge receipt and begin a preliminary conflict check.
Conflict Review
We complete a conflict check and assess the nature of your matter. If there is no conflict and we can assist, we arrange an initial consultation.
Strategy & Scope
We discuss your objectives, agree a scope of work, confirm the fee arrangement in writing, and establish a clear communication plan.
Communication & Delivery
We pursue your matter strategically, communicate progress plainly, and deliver advice and representation aligned to your commercial reality.
Fee arrangements depend on the matter.
Fee arrangements depend on matter scope, complexity, urgency, and a written mandate. Specific fee quotes are provided only after matter assessment, and are confirmed in writing before work begins. The information on this page is general and does not constitute a fee quote or an offer to act.
